Please read these Terms and Conditions carefully before using our webshop or mobile application (collectively, “Platform”). By accessing or using the Platform, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, you may not access or use the Platform.

1. Registration

Registration on our Platform is optional. However, unregistered users can only browse and read the pages on our Platform. Registration is required to access the rewards program and place orders online. If you choose to register, you will be required to provide us with certain personal information, such as your full name, phone number, birthdate, email address, and shipping address. You agree that the information you provide is accurate and up-to-date. By registering an account on our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

2. Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.

3. Orders

To place an order, you will be required to provide us with your billing information and shipping address. You agree to pay the applicable prices for the products you order, including any shipping and handling charges. We will charge your credit card or other authorized payment method upon confirmation of your order.

4. Delivery

We currently deliver only to the Netherlands. Delivery times are estimates and may vary depending on your location and the availability of products. We will not be liable for any delays in delivery.

5. Returns and Refunds

We offer a 14-day return policy for all products purchased directly from our Platform, except for fresh and frozen products. Fresh and frozen products are not eligible for returns unless they meet specific criteria, such as defects or damage upon delivery. Please contact us for a return authorization and instructions on how to return your products.

6. Intellectual Property

All intellectual property rights on the Platform, including but not limited to copyrights, trademarks, and patents, belong to Argo or our licensors. You agree not to copy, distribute, or modify any of the intellectual property on the Platform without our written permission.

7. Disclaimer of Warranties

The Platform is provided on an “as is” and “as available” basis. We make no warranties of any kind, express or implied, about the Platform, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

8. Limitation of Liability

In no event will we be liable to you for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or in connection with your use of the Platform, even if we have been advised of the possibility of such damages.

9. Indemnification

You agree to indemnify and hold harmless Argo and our affiliates, officers, employees, and agents from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the Platform, your violation of these Terms and Conditions, or your violation of any rights of a third party.

10. Modifications

We may modify these Terms and Conditions at any time by posting the revised terms on the Platform. Your continued use of the Platform after such modifications will constitute your acceptance of the revised terms.

11. Governing Law

These Terms and Conditions will be governed by and construed in accordance with the laws of the Netherlands. You agree to submit to the exclusive jurisdiction of the courts located in Groningen, Netherlands.

12. Entire Agreement

These Terms and Conditions constitute the entire agreement between you and Argo regarding your use of the Platform. These Terms and Conditions supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

13. Severability

If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck from these Terms and Conditions and the remaining provisions shall remain in full force and effect.

14. Waiver

Our failure to exercise or enforce any right or provision of these Terms and Conditions will not constitute a waiver of such right or provision.

15. Data Privacy and Use of Personal Information

We respect your privacy and are committed to protecting your personal information. By registering on our Platform, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy.

16. User Conduct

You agree not to use the Platform in a manner that is illegal, fraudulent, or harmful. Prohibited activities include, but are not limited to, unauthorized access to the Platform, misuse of promotional codes, or submitting false information.

17. Payment Processing and Security

Payments on our Platform are processed securely by third-party payment providers. We do not store your credit card information, and all transactions are encrypted to ensure your safety.

18. Cancellation of Orders

Orders may be canceled within 30 minutes of placement by contacting our customer service. After this period, cancellations may not be possible due to order processing.

19. Gift Cards and Promotional Codes

Gift cards and promotional codes cannot be redeemed for cash, combined with other discounts, or applied retroactively to previous orders.

20. Account Termination

We reserve the right to suspend or terminate your account at any time, without notice, if we believe you have violated these Terms and Conditions or engaged in fraudulent activity.

21. Errors and Omissions

We strive for accuracy but are not responsible for errors, inaccuracies, or omissions on the Platform, including product descriptions, pricing, or availability.

22. Force Majeure

Argo shall not be liable for any failure to perform due to circumstances beyond our control, including but not limited to natural disasters, strikes, or government restrictions.
